What Is Sexual Harassment?

West Virginia Admin. Code, Section 77-4-1 defines sexual harassment as “unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature.”

Sexual harassment can occur in a variety of environments, including in public, at school, and in the workplace. While West Virginia lacks criminal laws for sexual harassment in schools and workplaces, sexual harassment is a civil rights violation. Individuals and employers who commit or allow sexual harassment may be liable to compensate their victims for lost wages, emotional distress, and other damages that result from their unlawful conduct.

Someone Is Harassing Me in West Virginia—What Should I Do?

If someone is targeting you with sexual harassment, there are a few things you should do:

Let them know you disapprove of their conduct.

If it’s not safe for you to do so, you should contact an authority figure who can help you. At work, this may be a human resources professional. At school, consider speaking with an administrator. In some situations, it may also be necessary to contact law enforcement.

Complain to your employer.

It is absolutely essential that you place your employer on notice that you are being harassed. Give as much detail as possible about the harassment. Start by reporting the harassment to your supervisor. If you do not feel safe or comfortable doing so, or if the supervisor fails to stop the harassment, report it to his or her supervisor and/or your employer’s human resources department. Make sure to make or obtain a copy of any reports or statements you make.

Gather evidence.

Possessing evidence of how, when, and where the sexual harassment occurred can help you or an authority figure take action against the offender. If they send you texts or emails, make copies. If the harasser communicates verbally, consider trying to take a recording or video of what they say, after consulting with our attorneys about the circumstances under which you can do so legally.

Seek additional assistance if you don’t feel safe.
